Mr. Emmanuel Mumia joined the law firm of MG Law advocates in 2013 where he successfully undertook his articles of pupilage and was consequently retained as an associate advocate in the firm upon admission to the Bar in 2015. He was appointed partner in May 2018 and is tasked with heading the Litigation, Dispute Resolution and Recoveries Department. His other areas of specialization include;

Emmanuel is a personable, persuasive and charismatic individual. He is a good boardroom negotiator and an impeccable courtroom performer with exceptional presentation skills and a knack for drawing reasonable & logical legal conclusions from case arguments.

Emmanuel loves his books! He draws inspiration from the Bible and philosophy books that constantly enable him understand the philosophies and social foundations of law.  He was highly intrigued by the alchemy of law and philosophy as a first year law student when he read the book, “The concept of law “by Professor H.L.A Hart and hence took a keen interest in the Hart-Fuller debate on morality and law (published in the Harvard Law Review, 1958) which demonstrated a clear divide between the positivist and natural law philosophy, consequently he subscribes to the positivist school of thought!

When not practicing Law Emmanuel is involved in activities of public interest such us providing legal aid, in addition he is an active member of the St John’s ambulance. He also enjoys participating in various sporting activities and is currently learning Golf.

His mantra is based on Aristotle who once quipped that “at his best man is the noblest of all animals, separated from the law and justice he is the worst “accordingly he strives to master the law in a manner that undoubtedly ensures that justice is achieved at all times.

 

 

He has and continues to represent various national and multi-national organizations at the Public Procurement Administrative and Appeals Board

He has represented leading construction companies in construction-related disputes both in Arbitral Tribunals and in Court, including; successfully represented Roben Aberdare Ltd as assisting Counsel in a road construction tender arbitration matter (valued at Ksh 6B), successfully represented Dinesh Construction Ltd as assisting counsel in Arbitral Proceedings leading to an award of Kshs 141 M, was assisting counsel for China Gezouba Group Co. Ltd in a request for the review of a tender for civil works in the construction of Thwarke Dam (valued at Ksh 36 Billion) and also Represented Landmark Holdings in Arbitration proceedings (over a Ksh 1B claim).


Has represented Kenya Railways Corporation on a number of cross-cutting legal matters; part of the legal team that represented the organization in disputes relating to the construction of the SGR both in Court and the National Environmental Tribunal;


He handles high net value briefs on behalf of the law firm for financial firms and other corporate organizations; Led the team that successfully defended Jamii Bora Bank in multiple injunction proceedings leading to recovery of Ksh 430 Million, currently an acting advocate for several of the major Banks in various suits for claims amounting to over Ksh 1B


Has been involved in handling mergers, acquisitions and review of privatizations such us the restructuring of the Kenya Wine Agencies Limited (KWAL) upon its acquisition by Distell Ltd.


Advised Royal Media services against a claim lodged by the Kenya Association of Music Producers (KAMP) & the Performers Rights Society of Kenya (PRSIK) in respect of license fees. He is currently representing the media firm as assisting counsel in a defamation suit arising from an investigative piece on sports doping in Kenya that aired on Citizen TV


Was part of counsel for the Commission for University Education at the Supreme Court in the case challenging the decision by the Engineers Board not to recognize degrees awarded to Engineering students from Moi and Masinde Muliro Universities


He has a passion for legal drafting and is credited with drafting the constitution of the Kenya Golf Federation that is currently in use.
